Set up in January 2019, we specialise in commercial and construction litigation and arbitration. Our lawyers are very experienced in both these areas of law and have been involved in a number of significant cases. Our senior lawyers are considered leaders in their respective fields and have been widely recognised for their expertise. In addition to our expertise in commercial and construction related disputes, we have also developed an expertise in project related disputes, joint venture projects, energy and insurance related disputes.

We regularly appear in the Malaysian Courts dealing with all manner of litigation. Our practice is structured such that in any matter we have a team of lawyers involved in each dispute. Our lawyers also regularly appear in the Court of Appeal and the Federal Court.

Apart from appearing regularly in the Malaysian Courts, we have a very active arbitration and adjudication practice. Our lawyers have conducted more than 50 arbitrations domestically and internationally. In addition to construction related arbitration disputes, we are experienced in energy related disputes. Our expertise includes power plants, bio fuel and oil and gas related disputes. In terms of non-construction arbitration, we have been involved in disputes concerning shareholders agreements, supply agreements, breach of technology agreements and commercial disputes.

Our experience in international arbitration includes having to deal with and appear in arbitrations conducted in Singapore, India, Dubai and London.

Our Recent Experience

  • Defending a Malaysian company in a claim in excess of RM 1 billion in relation to the sale and purchase of share in an insurance company.
  • Defending a Malaysian construction company in claim amounting to RM 700 million in the Malaysian High Court. The claim involves issues of trespass and negligence.
  • Representing a Malaysian utility company in a dispute concerning the construction of a power plant. The claim and counterclaim are in excess of RM 200 million and has been referred to arbitration.
  • Representing a utility company in claim of RM 150 million concerning the construction of a power plant in east Malaysia. The dispute is to be heard a panel of 3 international arbitrators.
  • Acting for the developer of a multifaceted port complex in various disputes including a reclamation contract for the construction of various islands, the construction of various construction facilities and the development of the port.
  • Successfully arguing in the Federal Court that the Construction Industry Payment Adjudication Act was to applied prospectively only reversing earlier decisions of the Court of Appeal and the High Court.
  • Acting for the subsidiary of a sovereign fund in relation to issue relating to the exceptions to Turquand’s rule. The dispute relates to the acts of the management in entering into contracts which they were neither actually or ostensibly authorised to execute.
  • Acting for a government linked company in a claim for RM 120 million in an international arbitration. The dispute relates to allegations in relation to the cause and costs of carrying out rectification to the housing project.
  • Acting for a local Malaysian contractor in 8 separate disputes against the Government of Malaysia claiming the sum of approximately RM 150 million. The various disputes include a variety of infrastructure projects.
  • Representing a local Malaysian contractor in a dispute concerning the construction of the mass rapid transport system in Kuala Lumpur. The dispute including defending claims from the subcontractors as well as advising client on claims for extensions of time and the related loss and expense claims.
  • Defending a claim for approximately RM 100 million in relation to the termination of contract for the supply of cooling gas to 3 separate projects including a hotel, shopping complex and an apartment complex.
  • Acting for an Indian contractor and a Korean contractor in relation to the construction of an oil and gas facility. This dispute resulted in the parties referring the disputes to arbitration in India and in Singapore as well as adjudication proceedings and litigation in Malaysia.
  • Defending a Malaysian bank in claim for fraud, conspiracy and negligence for the sum of RM 500 million in relation to a project concerning a land swap as well as the construction of a housing project.
  • Representing a Chinese contractor in various disputes including litigation, arbitration and adjudication in relation to the construction of various condominium projects in Malaysia.
  • Acting for a German piling contractor in a number of disputes including a claim for RM 100 million in relation to the construction of a high-rise tower.
